Note: SCALPS provides cosmetic services; we are not a medical provider. HIPAA does not apply to our studio, and this policy is designed to meet U.S. standards and international best practices.

3. Media & Content Release
By booking or receiving services from SCALPS, you acknowledge and agree that:
- Photos and/or videos may be recorded during your session for documentation, education, or marketing.
- Unless you request otherwise prior to or during your session, you grant SCALPS irrevocable rights to use your image, likeness, voice, or recordings for marketing, social media, educational, or advertising purposes in any medium.
- You may opt out of photo/video use by informing staff before or during your appointment.
- Your name or direct identifiers will not be disclosed without your explicit written consent.
- All recordings created by SCALPS are our intellectual property and may be used indefinitely unless you revoke future use in writing.
How to opt out: Tell your artist before filming begins or email privacy@scalpsusa.com prior to your session.
4. Data Retention
We retain information only as long as needed for legitimate business, legal, or insurance purposes, then securely delete or anonymize it. You may request deletion where permitted by law.
5. Your Rights
You may request:
- A copy of your personal data we hold.
- Correction of inaccurate information.
- Deletion of data (where legally permitted).
- Revocation of media or marketing consent for future use.

6. Data Security
We employ industry-standard encryption, firewalls, and strict access controls. Only authorized and insured personnel can access client records.
7. Third-Party Sharing
We do not sell or rent your data. Limited information may be shared with:
- Payment processors, booking platforms, and marketing tools supporting SCALPS operations.
- Legal or insurance representatives when required for compliance or defense.
All third parties are bound by confidentiality and data-protection obligations.
8. Professional Liability & Limitation of Damages
- SCALPS is a cosmetic studio; results vary by skin type, lifestyle, and aftercare.
- To the fullest extent permitted by law, SCALPS is not liable for incidental, indirect, or consequential damages related to services, dissatisfaction, or authorized media use.
- All disputes are governed by New Jersey law with exclusive jurisdiction in Middlesex County.
9. Arbitration
Any controversy or claim arising out of or relating to this Policy, services, or communications with SCALPS shall be resolved exclusively through binding arbitration under the American Arbitration Association rules in Middlesex County, NJ. Judgment on the award may be entered in any court of competent jurisdiction.
10. Indemnification
You agree to indemnify, defend, and hold harmless SCALPS, its owners, and employees from claims, damages, liabilities, costs, and attorneys’ fees arising from your breach of this Policy, misuse of services, or violation of law.
11. Force-Majeure
SCALPS is not responsible for delays or failures due to causes beyond reasonable control, including natural disasters, power failures, cyberattacks, or governmental actions.
12. Non-Disparagement
You agree not to publish or communicate any false, misleading, or defamatory statements—online or offline—about SCALPS, its employees, or services. Honest opinions and fair commentary are acceptable, but knowingly false or harmful claims are strictly prohibited support@scalpsusa.com for resolution.
13. Children’s Privacy
Services are available only to clients 18+. If we discover information from a minor, we will delete it promptly.
14. Policy Updates
We may update this Policy periodically. Continued use of our website or services constitutes acceptance of any revisions.
