Terms of Service — Scalps Micropigmentation LLC

1. Services & Eligibility

SCALPS provides scalp micropigmentation and related cosmetic services. You must be 18+ and legally able to consent. We reserve the right to refuse service for safety, ethical, or policy reasons.

2. Appointments, Cancellations & Payments

• Deposits, balances, cancellation windows, and no-show fees are disclosed at booking and are non-refundable unless stated otherwise.
• Payments are processed through secure third-party processors; we do not store full card numbers.
• Promotions and discounts are limited-time and subject to eligibility.

3. Results Disclaimer

Scalp micropigmentation outcomes vary by skin type, physiology, lifestyle, and aftercare adherence. We make no guarantees or warranties, express or implied, regarding specific results, longevity, pigment behavior, or color stability.

4. Liability Waiver

To the fullest extent permitted by law, you release and hold harmless SCALPS, its owners, and employees from any claims, damages, or losses (including incidental, indirect, special, or consequential damages) arising from or related to services received, including dissatisfaction, allergic reactions, irritation, or infections, except where prohibited by law.

5. Media & Recording

Media use and consent are governed by our Privacy Policy. In summary:

• Photos/videos may be recorded for documentation, education, and marketing.
• Unless you request otherwise prior to or during your session, you grant SCALPS rights to use your image/likeness/voice in any medium for promotional or educational purposes.
• Your name or direct identifiers will not be disclosed without your explicit written consent.
• You may opt out by notifying staff before filming or at the start of your appointment.

6. Client Conduct & Impairment

• You agree to arrive sober and not under the influence of alcohol, cannabis, or other substances that could impair consent or compromise results.
• We may refuse or discontinue service, postpone sessions, or refrain from filming if impairment is suspected.
• Abusive, threatening, or harassing behavior toward staff or other clients will result in immediate termination of services and possible removal from the premises.

7. Intellectual Property

All website content, training materials, studio imagery, and recorded media are owned by SCALPS or licensed to us and protected by intellectual-property laws. No content may be copied, modified, distributed, or exploited without our prior written consent.

8. Reviews, Communications & Non-Disparagement

We welcome honest feedback and fair commentary. You agree not to publish or communicate any false, misleading, or defamatory statements—online or offline—about SCALPS, its employees, or services. This clause does not restrict truthful opinions about your experience. For concerns, contact support@scalpsusa.com for resolution.

9. Indemnification

You agree to indemnify, defend, and hold harmless SCALPS, its owners, officers, and employees from any claims, damages, liabilities, costs, and attorneys’ fees arising from your breach of these Terms, violation of law, misuse of services, or misuse of media consent.

10. Dispute Resolution & Arbitration

Any controversy or claim arising out of or relating to these Terms, our services, or communications with SCALPS shall be resolved exclusively by binding arbitration administered by the American Arbitration Association in Middlesex County, New Jersey. Each party bears its own fees unless the arbitrator awards otherwise. Judgment on the award may be entered in any court of competent jurisdiction.

11. Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflicts of law. Subject to the arbitration clause, the exclusive venue for any permitted court action is in the state or federal courts located in Middlesex County, New Jersey.

12. Force-Majeure

SCALPS is not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, acts of God, epidemics, power or internet failures, cyberattacks, labor disputes, or governmental actions.

13. Privacy & Data

Your information is handled according to our Privacy Policy, which is incorporated by reference. By using our website or services, you consent to the collection and use of information as described therein.

14. Changes to Terms

We may update these Terms periodically. The “Last Updated” date will reflect changes. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
